MEMBERSHIP AND TERMS OF USE AGREEMENT

1. INTRODUCTION
This Membership and Terms of Use Agreement (“Agreement”) is made electronically between 3RED TURİZM TAŞIMACILIK SANAYİ VE TİCARET LİMİTED ŞİRKETİ (“3RED”), the owner of the website www.3red.com.tr (“Site”), and all natural and legal persons (“User”) who become members of the Site or use the services provided on the Site without being members.
By completing the membership form or continuing to use the services provided on the Site, the User declares, accepts, and undertakes that they have read, understood, and agreed to be bound by all terms and conditions of this Agreement.
2. PARTIES AND DEFINITIONS
2.1. 3RED:
3RED TURİZM TAŞIMACILIK SAN. VE TİC. LTD. ŞTİ., a company headquartered at GEBİZLİ MAHALLESİ TERMESSOS BLV. PLAZA GLK İŞ MERKEZİ SİT. NO: 42 /2/102 MURATPAŞA/ANTALYA, is the owner and operator of the website www.3red.com.tr.
2.2. User:
Any natural person aged 18 or older or any legal entity representative who registers to the Site or uses the services provided on the Site without registering.
2.3. Site:
The digital platform operated by 3RED at www.3red.com.tr, where users can access car rental services.
2.4. Membership:
The process by which a User completes the registration form accurately and fully, confirms electronically, and is approved by 3RED.
3. MEMBERSHIP CONDITIONS AND USER OBLIGATIONS
3.1. Membership can only be completed using a valid email address. Multiple registrations with the same email address are not allowed.
3.2. The User declares and undertakes that all information provided during registration is true, complete, and up to date. The User is solely responsible for any legal consequences arising from the provision of false or misleading information.
3.3. The User may not share their account credentials with any third party. The User is solely responsible for all activities carried out through their membership account.
3.4. 3RED reserves the right to request additional information or documents, reject membership applications, suspend, or terminate existing memberships at its sole discretion.
4. DESCRIPTION AND SCOPE OF SERVICE
4.1. The primary service provided through the Site is to enable users to make online car rental reservations.
4.2. Services such as reservations, payments, vehicle delivery and return, insurance, cancellations/refunds, etc., may be subject to additional agreements or special terms. In case of any conflict, special terms shall prevail over this Agreement.
5. PRIVACY AND PROTECTION OF PERSONAL DATA
5.1. 3RED processes, stores, and protects Users' personal data in accordance with the Personal Data Protection Law of the Republic of Türkiye (KVKK) and related legislation.
5.2. By registering or using the Site’s services, the User acknowledges having read and accepted the Privacy Notice.
6. INTELLECTUAL PROPERTY RIGHTS
All content on the Site (including but not limited to designs, software, visuals, texts, logos) is the exclusive property of 3RED. The User may not copy, reproduce, modify, distribute, or publish this content without prior written permission from 3RED.
7. TERM AND TERMINATION
7.1. This Agreement enters into force once the User registers on the Site or begins using its services, and remains in effect indefinitely.
7.2. The User may terminate their membership at any time. 3RED may suspend or cancel the User’s membership in the event of a breach of the terms of this Agreement.
8. LIMITATION OF LIABILITY
8.1. 3RED does not guarantee uninterrupted or error-free operation of the Site. It is not liable for disruptions caused by technical issues, system updates, or force majeure.
8.2. The User agrees to comply with all applicable laws, moral standards, and internet ethics while using the Site.
9. DISPUTE RESOLUTION AND JURISDICTION
Any dispute arising from the implementation of this Agreement shall be governed by Turkish Law, and the Courts and Execution Offices of Antalya shall have exclusive jurisdiction.
10. ACCEPTANCE AND ENFORCEMENT
By becoming a member of the Site or using its services in any manner, the User declares and acknowledges that they have read, understood, and agreed to be bound by all provisions of this Agreement.
